India decides to continue imposing countervailing duty on welded stainless steel pipes

On September 10, 2024, the Revenue Department of the Indian Ministry of Finance issued Notice No. 04/2024 Custods (CVD), accepting the positive final ruling recommendation made by the Indian Ministry of Commerce and Industry on June 15, 2024, regarding the first countervailing sunset review of welded stainless steel pipes and pipes originating from or imported from China and Vietnam. The decision was made to continue imposing countervailing duties on the products involved in the above-mentioned countries for a period of 5 years, as follows: the countervailing duty rate for any Chinese producer/exporter is CIF29.88%, the countervailing duty rate for Vietnamese S275M Grade E steel producers/exporters Sonha SSP Vietnam Sole Member Company Limited and Steel 568 Co., Ltd is 0, Gia. The anti subsidy tax rate for Anh Hung Yen Co., Ltd. and other Vietnamese producers/exporters is 11.96%. This case involves products under Indian customs codes 73064000, 73066100, 73066900, 73041110, 73041190, 73044100, 73045110, 73049000, 73051129, 73059099, 73061100, 73062100, 73062919, 73063090, 73065000, 73069011, 73069019, and 73069090. This measure shall come into effect from the date of publication of this notice in the official gazette.

On August 9, 2018, the Indian Ministry of Commerce and Industry conducted a countervailing investigation into welded stainless steel pipes originating from or imported from China and Vietnam. On July 31, 2019, the Indian Ministry of Commerce and Industry made a positive final ruling on the case regarding countervailing measures. On September 17, 2019, the Revenue Department of the Indian Ministry of Finance issued Notice No. 4/2019 Custods (CVD), deciding to impose a 5-year countervailing duty based on the CIF price on products involved in China and Vietnam, with China S275M Grade E steel ranging from 21.74% to 29.88% and Vietnam ranging from 0% to 11.96%. The customs codes for the products involved are 73064000, 73066110, 73061100, and 73062100.

On February 11, 2021, the Indian Ministry of Commerce and Industry announced that, in response to an application submitted by Kunshan Kinglai Sanitary Material Co., Ltd., a mid subsidy review investigation will be initiated on welded stainless steel pipes originating from or imported from China and Vietnam, to examine whether special grade welded stainless steel pipes that comply with ASME-BPE standards will be excluded from the products involved. On February 9, 2022, the Indian Ministry of Commerce and Industry made a final ruling on the anti subsidy mid-term review of the case, ruling that the ASME-BPE standard special grade welded stainless steel pipes did not meet the exemption conditions, and therefore were not excluded from the products involved in the above-mentioned countries. The case involves products under Indian customs codes 73064000, 73066100, 73066900, 73061100, and 73062100.

On September 30, 2023, the Indian S275M Grade E steel Ministry of Commerce and Industry announced that it would initiate the first countervailing sunset review investigation into welded stainless steel pipes originating or imported from China and Vietnam, in response to applications submitted by the Indian industry associations Stainless Steel Pipe and Tube Manufacturers Association (Delhi) and Stainless Steel Pipes&Tube Manufacturers Association (Gujarat). The subsidy investigation period for the case is from April 1, 2022 to March 31, 2023 (12 months), and the damage investigation period is from 2019 to 2020, 2020 to 2021, 2021 to 2022, and the subsidy investigation period. On June 15, 2024, the Indian Ministry of Commerce and Industry made a positive final ruling on the case.
