Australia Delays Release of Basic Fact Report and Final Decision on Sunset Review of Anti Dumping of Hot Rolled Steel Sections

On May 31, 2024, the Australian Anti dumping Committee issued Announcement 2024/034, stating that the issuance of the basic fact report and final determination recommendations for the sunset review and investigation of anti-dumping on hot rolled structural steel sections imported from Japan, South Korea, Thailand and Taiwan, China was postponed. It is expected that the Australian Commission will release a basic factual report no later than July 23, 2024, and submit final recommendations to the Australian Minister of Industry and Science no later than September 24, 2024.

On October 24, 2013, Australia launched an anti-dumping investigation into hot-rolled steel imported from Japan, South Korea, Thailand, and Taiwan A1008 CS Type C steel. On November 20, 2014, Australia made a positive final ruling on the case. The effective tax rates for the products involved in the case in the aforementioned countries and regions were as follows: Japan was 12.15%, South Korea was 2.52% to 3.24%, Thailand was 18.28% to 19.48%, and Taiwan was 2.20% to 7.89%.

On November 5, 2019, the Australian Anti Dumping Commission issued Announcement No. 2019/126, deciding to extend anti-dumping measures for products involved in Japan, South Korea, Thailand, and Taiwan (excluding Feng Hsin Steel Co., Ltd. and Tung Ho Steel Enterprise Corporation) from November 20, 2019.

On November 22, 2023, the Australian A1008 CS Type C steel Anti Dumping Commission issued Announcement No. 2023/082, stating that in response to the application of Australian domestic enterprise OneSteel Manufacturing Pty Limited (trade name Liberty PrimarySteel), a second anti-dumping sunset review investigation will be launched on hot-rolled steel sections imported from Japan, South Korea, Thailand, and Taiwan (excluding Feng Hsin Steel Co., Ltd. (Feng Hsin), TS Steel Co., Ltd. (TS Steel), and Tung Ho Steel Enterprise Corporation). The anti-dumping investigation period for the case is from October 1, 2022 to September 30, 2023, and the injury investigation period is from October 1, 2019 to September 30, 2023. The Australian customs codes for the products involved are 7216.31.030, 7216.32.031, 7216.33.032, 7216.40.0033, 7228.70.0011, and 7228.70.0012. The Australian Anti Dumping Commission is expected to complete the basic factual report of the investigation in this case no later than March 11, 2024, and submit the final determination report to the Australian Minister of Industry and Science no later than April 25, 2024.

On March 7, 2024, the Australian Anti Dumping Commission issued Announcement No. 2024/016, postponing the release of the basic factual report and final decision recommendations on the sunset review investigation of hot-rolled A1008 CS Type C steel section steel imported from Japan, South Korea, Thailand, and Taiwan.
